Assigning Connecticut LUST claims to NatLUST is an easy process. The instructions are slightly different depending on if you are assigning a 'backlogged' claim or filing a 'new' initial/supplemental claim.
Instructions For “Old” Claims (Claims Submitted To DEP Prior to June 1, 2005)
- Applicants with backlogged claims must first get them approved by DEP and the Review Board in order to receive funding through NatLUST.
- Applicants can either (a) allow their claims to be processed by DEP’s normal procedures; or (b) participate in DEP’s new ' Percentage Acceptance' program, which will allow for expedited approval, albeit at a discount based on a formula. Contact DEP's Jacques Gilbert (860-424-3336) or Paula McDowell (860- 424-3252) directly to inquire about the amount your claim would receive under the terms of the DEP’s Percentage Acceptance program.
- Irrespective of whether you elect to participate in the DEP’s Percentage Acceptance program, you must execute a copy of DEP’s Notification of Assignment and Payment Direction Form. See DEP's Instructions and how to enter NatLUST's payee information.
- Mail original copies of the above forms to DEP. Fax executed copies of the above documents along with NatLUST's CT-1 Assignment Form to NatLUST at 866-852-9007. See NatLUST's assignment instructions. If your reimbursement application originally instructed DEP to pay your consultant, the Applicant must select the ‘direct pay’ option whereby NatLUST will pay that same consultant.
- Kindly note that NatLUST advises that tank owners and consultants assign claims before they are sent to the Review Board; however; DEP will also allow you to assign your claim within the first 20 days following the Review Board issuing a decision.
Instructions For “New” Claims (Claims Not Previously Submitted to DEP)
- Download and complete either an Initial Claim Application (instructions) or a Supplemental Claim Application (instructions) as appropriate. Click here for instructions on how to enter NatLUST's payee information.
- Mail DEP signed originals of DEP’s (i) claim Reimbursement Application Form, (ii) Notification of Assignment and Payment Designation Form, plus (iii) DEP’s required supporting documentation (invoices, etc.).
- Kindly note that ‘new claims’ are not eligible for DEP’s ‘Percentage Acceptance’ program and will be processed according to DEP’s normal claim review procedures; and
- With the exception of your invoices, fax the DEP forms listed above plus an executed copy of NatLUST's CT-1 Assignment Form to NatLUST at 866-852-9007. Please do not mail your entire claim reimbursement package to NatLUST or you will be charged $10 for us to forward it to DEP.
UCC Instructions for Businesses Assigning $50,000 or More of Claims
If the claimant has has granted a prior lien on its assets (excuding mortgage type debt) to another financial institution, we may require that the claimant's bank allow us to file a UCC-3 release. Exceptions to this will be made on a case-by-case basis, but generally only to large businesses that are creditworthy.
Have the claimant's bank download a copy of NatLUST's UCC Form Letter and fax it to us on their letterhead. NatLUST will then file the UCC-3.
UCC-3 filings are good for 5 years.
