Assigning Connecticut LUST claims to NatLUST is a quick and easy process, which varies only slightly depending on if you are assigning 'old' claims that have already been submitted to DEP, or 'new' claims that you intend to submit now. The 3 main forms are (a) DEP Payment Direction Form; (b) DEP 'Corporate Resolution' and (c) NatLUST's CT-1 Claim Assignment Form. You need to fill out one DEP Payment Direction Form and one NatLUST CT-1 form for each claim you intend to assign. DEP will allow you to file one corporate resolution form that is good for a year.

#1- Mail DEP signed and notarized originals of DEP's Assignment Designation Form and, if applicable, the appropriate Corporate Resolution form.
and # 2 - Fax NatLUST an executed copy of NatLUST's CT-1 Payment Assignment Form plus the Assignment Designation and, if applicable, corporate resolution form listed above. Include a copy of your decision letter if you have it.
Remember that DEP has established a rule that states you must make the assignment within the 20-day period following the Review Board issuing the claim decision. ____________________________________________________________________________________ "New" Claims (Claims Not Previously Submitted to DEP)

____________________________________________________________________________________ UCC Instructions for Businesses Assigning $50,000 or More of Claims
If the business has granted a prior lien on its assets (excuding mortgage type debt) to another financial institution we may require that the claimant's bank allow us to file a UCC-3 Release. Exceptions to this will be made on a case-by-case basis, but generally only to large businesses that are creditworthy. If you are not certain on whether you or your client may be required to do this, give us a call. If we decide that a UCC-3 release filing is required, have the Banker download a copy of the Form Letter and fax it to us on their letterhead. NatLUST will file the UCC-3 and deduct the $25 charge from either the Initial or Residual payment. UCC-3 filings are a one time event. Once the release is filed you wil not have to do this again for at least 5 years.
