Instructions For NatLUST Financing of Virginia Claims

NatLUST Has Established the Following Procedures for Claimants Financing Virginia VPSTF Claims:

For those parties familiar with the VRA program, the main change in procedures is that DEQ will allow assignments to be made using a "modified" version of its longstanding FORM 2 Payment Assignment Form rather than the VRA type form. As explained below, NatLUST will retain its own payment assignment form to be used in certain cases; however, DEQ will not receive it.

Here is what you need to do to get paid by NatLUST:

  • Claimants must submit a signed and notarized copy of the DEQ's modified Form 2 along with the normal VPSTF reimbursement package (i.e, Form 1, AAF Cost worksheet, invoices, etc.). Do not use the old version Form 2. "VSBFA (NatLUST Program" must be the named assignee on the DEQ's Form 2 (not the consultant or the claimant).   • Assuming the consultant is the party to receive payment from NatLUST, and they have already provided a W-9 to NatLUST, NatLUST will not require that they execute a copy of NatLUST's own assignment form; however, the claimant and/or consultant can do so at their option. Kindly note that unless we are instructed otherwise, if you choose to simply use the DEQ's FORM 2, NatLUST will always pay the consultant. NatLUST is providing this flexibility for several reasons. First, it makes sense to eliminate the requirement that consultants file a W-9 with every claim. Also, VRA's experience has been that 98% of the time, checks are going directly to the consultants. Finally, many consultants have suggested that they would prefer to keep the number of forms that their clients have to sign to a minimum.

 

  • In the rare event where the claimant is the intended NatLUST payee and NatLUST does not already have a W-9 from them on file, the claimant must complete the NatLUST assignment form. The reason is that we want the claimant to acknowledge that they understand the NatLUST program, plus we are required by the IRS to collect their W-9.

 

  • Just like with the VRA program, mail the entire VPSTF reimbursement package (including the Form 2 and, if applicable, the NatLUST assignment form) to NatLUST:

Kindly note that NatLUST will try to come up with ways to simplify these procedures and we welcome any suggestions you may have. We understand that DEQ is revising some of its procedures and forms, and this may result in a more streamlined process in the future. Also, the NatLUST database is currently being beta tested. By mid summer, we expect to make this available, at which time consultants will be granted administrative ability to set up and edit their own NatLUST financed claims via the web.
